MRI “Contrast Dye”: Another Death, Zero Responsibility
MRI Gadolinium Contrast Awareness has done an excellent job documenting and getting the word out on the maiming and killing done by the “Contrast Dye” pushed by hospitals for MRIs and CT Scans.
Even the Federal Drug Advocates recognizes there are problems with Gadolinium, but inexplicably declares the patient has no right to be told of the risks in advance. Note the repeated use of the word “should”, not “shall”, as to whether the patient is told anything. Even if the patient asks, the operative word is still “should”. Get a load of this: “A health care professional who determines that it is not in a patient’s best interest to receive a Medication Guide because of significant concerns about its effects may direct that it not be provided to that patient...”.
In the case of a death caused by the University Of Iowa, the physicians will pay zero. The State will pay zero--it will simply steal (tax) people who were not involved in any way to pay for the murder it's responsible for—in this case, paying a little more in insurance premiums at some point. And even if the "annual cap" is later exceeded, no Legislator, no hospital administrator, no doctor, no nurse, is going to dip their hand in their own pocket to pay any price.
On the other hand, if you rob a liquor store, you're likely going to jail and probably prison. None of the people involved in the killing of Katherine Decker will even be fingerprinted, or spend a nanosecond in the local jail.

The State Appeal Board agreed Monday to a $2 million settlement with the daughters of a Muscatine woman who died in 2018 from an allergic reaction to a contrast dye administered during an MRI at the University of Iowa Hospitals and Clinics.
UI Physicians — a UI Carver College of Medicine-based medical and surgical group of 1,000-plus doctors, which owns an insurance company established to provide them medical malpractice coverage — will cover the full amount, as the group hasn’t yet reached its $15 million annual cap.

This cryptic line in the above article caught my attention:
"'The recent law that was passed that limits non-economic damages awards does not apply in this case,' according to a recommendation from Deputy Attorney General Stan Thompson."
Having lived in California for the past 24 years, and seeing lawsuits never brought because California has severe limits on recovering any significant monetary damages from doctors and hospitals, I did a little digging and found this:
“Cash awards for pain, suffering and other non-economic complications from medical malpractice lawsuits will be capped under a new provision signed into law Thursday by Iowa Gov. Kim Reynolds.
Those non-economic damages in medical malpractice cases are now capped at $2 million for cases in which a hospital is found to be at fault, and $1 million when the doctor is at fault.
The new law, which becomes effective immediately, does not cap jury awards for economic or punitive damages.”
